ARTICLE 2: INTELLECTUAL PROPERTY
2.1 - Without this list being exhaustive, the KRETZ & PARTNERS and KRETZ brands as well as any derivatives or variations, logos, graphic charts, the layout, any information, the presentation and the content of the Site (videos, images, texts, photographs, etc.), will remain the exclusive property of the Company, or the latter holds the rights and any authorisations required to use them. The Company is the holder of any intellectual property rights associated with both the structure and the content of the Site, unless explicitly stated otherwise.
2.2 - Any reproduction or representation of the Site or its component elements, such as trademarks, logos, graphic charts, layout, information, photographs, presentation and content of the Site, without this list either restrictive or not, and either full or in part, is prohibited.
2.3 - These T&Cs do not permit the transfer of any intellectual property rights for the benefit of the User, either in terms of the structure or in relation to online content.
2.4 - The User explicitly agrees that any use made of the Site does not in any way infringe the rights of the Company, and specifically that this use does not constitute counterfeiting or unfair or parasitic competition.
ARTICLE 3: THIRD-PARTY SITES/HYPERTEXT LINKS
Outgoing hypertext links may be present on the Site, however the web pages to which these links are directed do not in any way make the Company responsible, as it has no control over them. The User clicks on these links and will be redirected to the related websites under his/her sole responsibility. Any information which can therefore be accessed via a hypertext link to other sites is not under the control of the Company, whose liability cannot be accepted. The identification of any hypertext links to all or part of the Site is strictly prohibited, except with prior written consent from the Company having been given. Any link must be removed at the Company's simple request under all circumstances.
ARTICLE 4: LOGGING IN
4.1 - Access to the Site is free of charge and it can be viewed without requiring any prior registration. The equipment and material resources allowing access to the Site, their updates, correct functioning and maintenance remain the sole responsibility of the User. The latter will also bear the cost of telecommunications charges incurred to access and consult the Site (the costs for the internet service provider specifically).
4.2 - The Company grants the User a right to consult and access any of the information accessible on the Site to the exclusion of any other rights.
4.3 - The User accepts without condition or reservation that the navigation and use of the Site are under his/her sole responsibility.
4.4 - The Company agrees to make every effort to ensure that Users of the Site have maximum access to the Site except in cases of force majeure, an event beyond its control, and those subject to maintenance periods and potential system shutdowns.
The Company cannot be held responsible for connection problems specific to the computer equipment of Users of the Site or which are linked to a failure of the Internet access provider being used.
ARTICLE 5: MODIFICATIONS
The Company reserves the right to modify or supplement these legal notices at any time and without giving notice. Users are required to review these legal notices on a regular basis.

This Privacy Policy is intended to inform Users of the www.kretzrealestate.com website (hereinafter the “Site”), about the any processing carried out by KRETZ & PARTNERS (hereinafter the “Company”), as a Data controller, in accordance with the provisions of law no. 78-17 dated 6th January, 1978 relating to data processing, files and acts of liberty, modified under law no. 2018-493 dated 20th June, 2018 following the entry into force of the General Data Protection Regulation (hereinafter the “Law”).
Users of the Site are invited to read this Privacy Policy carefully.
ARTICLE 1. DEFINITIONS
Personal information/data
This means any information relating to a human being who has been identified or who can be identified, either directly or indirectly, by reference made to an identification number or to one or more elements specific to him/her. This may include the User's surnames, first names, telephone number, e-mail and postal address or gender (e.g. female, male).
Cookies
These designate automatic text file type tracing processes positioned on a terminal (computer, tablet, Smartphone) which record information during the visit to a website or when viewing an advertisement. Cookies can have various purposes, and retain information for a certain period of time.

This refers to this privacy policy relating to the processing of User Data and the use of Cookies on the Site.
Data controller
This is KRETZ & PARTNERS, SARL with a capital of € 44,000, enrolled with the RCS of Nanterre under number 494 861 560, whose registered office is located at 19b avenue Robert Schuman 92100 Boulogne, duly represented by its co-manager Mr. Olivier Kretz, and which determines the purposes and methods of processing as defined herein.
Processing
This refers to any operation or series of operations relating to Data, such as the collection, recording, storage, consultation, communication or even the erasure and destruction of Personal Data.
User
This refers to any individual accessing the Site whether or not they are a customer of the Company.
ARTICLE 2. GENERAL INFORMATION
This Privacy Policy may be modified at any time by the Company, in particular in order to comply with changes to the law, case law, technology or even to requirements set by the authorities. The Company will inform the User and/or seek their agreement whenever required in the event of a modification to the Privacy Policy.
The most recent version of the Privacy Policy is the one which is available on the Site.
Users are invited to review the Privacy Policy before browsing the Site and to read the Privacy Policy on a regular basis in order to find out about any modifications and/or updates made by the Company.

ARTICLE 3. THE INDIVIDUALS AFFECTED BY PROCESSING
The individuals affected by any Data processed by the Company are the Users of the Site, and in particular:
- Users visiting the Site
- Users filling out the various forms on the Site (contact, valuation of a property, creation of a dedicated alert, sharing a property referenced on the Site via e-mail).
ARTICLE 4. DATA COLLECTION
4.1 - The User's Personal Data may be collected directly or automatically by the Company whenever using the Site.
Personal Data is collected specifically via forms associated with their:
- marital status (surname, first name) *
- address *
- e-mail address *
- telephone no. *
- characteristics of the User's property (apartment, house, area in m2*, number of rooms, floor)

4.2 - Communication of information with an asterisk (*) is essential for respective processing among any Personal Data listed below. The Company will not be able to respond to his/her request if the User does not wish to provide the information requested, and in particular for those which include an asterisk (*) The communication of other Personal Data is optional, and will be left to the User's discretion.
The User may also communicate any other information that he/she wishes to bring to the attention of the Company, on the understanding that providing this information is not mandatory. The Company will process the latter under the conditions provided for herein and in accordance with the law if the User transmits any Personal Data within this context.
4.3 - The User's Personal Data may also be collected through Cookies, subject to the User's choices regarding these Cookies, and these may be modified at any time (For further information: see Article 10 of the Privacy Policy).
4.4 - The Company does not collect any sensitive data online within any legal contexts.
4.5 - The Company allows the User to send to the person of his choice, via his own e-mail address, a link redirecting to a real estate ad on the Site. The User who wishes to use this feature acknowledges that the sending of this e-mail is done under his sole responsibility and ensures that he has obtained the consent of the person concerned in order to send him this e-mail.
ARTICLE 5. LEGAL BASES AND PURPOSES FOR PROCESSING
5.1 - The Data is used by the Company in accordance with the law. The processing of Data is therefore lawful provided that:
- it aims to respond to requests/applications from the User in question and/or;
- it aims to comply with the legal obligations to which the Company is subject and/or;
- the User has given consent for his/her Data to be processed and/or;
- there is a legitimate interest being pursued by the Company. The legitimate interest of the Company is primarily based on commercial and financial reasons which require Personal Data to be processed by them.
5.2 - Any Data referred to in Article 4 above will be collected and processed for the following purposes:
- handling responses to User requests relating to:
1) The valuation of a property;
2) Miscellaneous requests for information;
3) The creation of a dedicated e-mail alert when searching for a property;
4) The sharing of a property referenced online via e-mail.
- sending any information concerning promotional operations and other events as part of corporate communication;
- processing real estate transactions;
- management requests to exercise rights;
- compiling trade statistics;
- identifying forms of evidence require for the safeguarding the rights of the Company.
ARTICLE 6. RETENTION PERIOD
6.1 - Personal Data will not be retained beyond any period which is strictly required for the purposes pursued as set out in this Privacy Policy and in accordance with the law.
6.2 - Any Personal Data collected in order to respond to requests for an estimate of the value of a property or for various requests for information will br retained until the Company provides a response to the User's request. Any Personal Data concerning him/her will then be deleted once the response has been sent by the Company to the User.
Any Personal Data collected for the purpose of creating an e-mail alert dedicated to the search for property will be retained until the User unsubscribes, which can be done at any time.
Any Personal Data collected with a view to sharing a property referenced online via e-mail will be retained until the Company has shared the email with the aforementioned property.
Any Personal Data used may be retained for a period of three (3) years from when it was collected, or from the last contact from the prospect (the earliest date will be retained) once the User has given his/her consent in order to receive commercial communications, notwithstanding any of the previous terms. The Company may contact the User in question to find out if he/she wishes to continue to receive commercial applications at the end of this period. The Company will delete any Data in accordance with the legislative and regulatory provisions in force should this response be negative.
Any Personal Data collected for the purpose of processing real estate transactions will be retained for the duration of the relationship between the User and the Company and for a period of ten (10) years following the last contact between the User and the Company. This retention period corresponds to the sale cycles of property, and is justified by the nature of the Company's trading activity, the mission entrusted to it and any obligations for which it is bound in a professional capacity.
Any Data collected regarding handling requests to exercise rights will be retained for between one (1) year and six (6) years depending on the right being exercised.
Any Data collected for the purpose of producing commercial statistics will be retained for a period of two (2) years from the most recent contact.
However, any Personal Data providing evidence of a right or a contract to be entered into, or which is being retained to comply with a legal obligation, may be subject to secure archiving for a period not exceeding the duration required for the purposes for which they are kept (in particular but not exclusively for those provided for by the French Commercial Code, the French Civil Code and the French Consumer Code but also by accounting and tax provisions which apply to the Company).
Cookies have a maximum lifespan of thirteen (13) months.
ARTICLE 7. DATA ACCESS
7.1 - All or part of the Company's authorised members of staff may have access to all or part of any Personal Data. Any individuals who can access Personal Data are subject to an obligation of confidentiality.
7.2 - The Company's partners and subcontractors may also have access to the Data, in particular:
Any processing carried out by the Company's service providers and partners is governed by a contract in which they agree to comply with the law and all the obligations they must honour, in particular those associated with security and the confidentiality of Data.
- sales executives linked to the Company as part of their real estate negotiation missions, management of the commercial relationship and surveying;
- the Company's service providers responsible for hosting the Site and the Data;
- the Company's service providers responsible for online development and maintenance;
- the Company's service providers responsible for managing analysis and target audience measurement tools.
7.3 - The Data may also be transmitted to the judicial and inspection authorities and to both court officers and ministerial officers as part of their debt collection policy and for safeguarding the Company's interests.
ARTICLE 8. DATA TRANSFER
User Data is stored by the Company within the European Union.
However, it does so to the extent that certain service providers and subcontractors of the Company may be located in third party countries outside of the European Union, and the Company may transfer User Data to these third party countries. The Company will ensure under these circumstances that this transfer is made in accordance with the Privacy Policy and with the law, but will also make sure that the subcontractor/service provider guarantees a sufficient level of protection of privacy and fundamental rights of the User.
ARTICLE 9. PROTECTING PERSONAL DATA
The Company agrees to put appropriate measures in place to preserve the security and confidentiality of the Data given the state of knowledge, the costs of implementation and the nature of the Data in question. The Company will therefore act carefully to prevent any Data from being distorted or damaged or any unauthorised third parties gaining access to it.
The Company will specifically ensure:
- it will raise awareness of the confidentiality requirements of Company employees who have access to the Data;
- it will secure access, share and transfer Data;
- a high level of Data protection requirements when appointing the Company's subcontractors and partners.
The Company cannot however be ultimately held responsible for the risks and complications inherent in the use of electronic networks.

10.1 - The Company collects information relating to login credentials and navigation via Cookies every time a User's visits the Site.

ARTICLE 11. DATA BREACH(ES)
11.1 - The Company will make every effort to protect the Personal Data of Users as effectively as possible and will take the evolution of technology into consideration.
Nevertheless, it is understood that no transmission or storage technology is infallible, despite the extent of the measures taken, and this is specifically because the rapid development of security technology.
11.2 - The Company will communicate this violation to the Users in question at the earliest opportunity, except in cases of exceptions provided for by law in the event of a violation of Personal Data which is likely to create a high risk for the rights and liberty of human beings.
The Company will inform the Commission Nationale de l'Informatique et des Libertés (CNIL) of the violation in question as soon as possible should Personal Data be breached, and will do so no later than within the time limits provided for by law, unless the violation is not likely to create a risk for the rights and liberty of human beings.
ARTICLE 12. USER RIGHTS
12.1 - The User reserves the right to access any Personal Data concerning him/her and to request that it be rectified, completed or updated. The User may also request that any Personal Data concerning him/her be deleted or may object to it being processed. He/she may also request that any processing of his/her Personal Data be restricted.
The latter may withdraw this request at any time, and the Company will therefore agree to cease any processing in question as soon as possible with regard to any processing on the basis of the User's consent.
The User may request to exercise his/her right to the portability of his/her Personal Data, i.e. the right to receive any Personal Data he/she has provided in a structured format, and the right to transmit this Personal Data to a third party.
Notwithstanding any previous procedures, the Company may retain certain Personal Data regarding the User when the laws and regulations applicable to its activity require this or when it has a legitimate reason to do so.
The User may formulate any directives relating to the storage, deletion and communication of his/her Personal Data after his/her death (storage, deletion or communication to a designated third party).

The User may lodge a complaint with the National Commission for Computing and Liberties (CNIL): www.cnil.fr un the event of a dispute associated with implementation of his/her rights.
ARTICLE 13. THIRD PARTY WEBSITES
If the User uses the links present on the Site to consult third-party sites (in particular social networking sites, Netflix, YouTube, etc.), the Company strongly recommends that the User take note of the provisions of the confidentiality and cookie policies of the sites he/she consults.
The Company shall not be held liable for Data Processing carried out by third-party websites.
The User is invited to take note of the links to the privacy policies of the main third party sites present on the Site. The User's attention is nevertheless drawn to the fact that this list is not exhaustive, as the Company may integrate new links to other third-party sites.
